Items for the published agenda shall be submitted in writing to the Academic Senate President (the President) by the end of day, 4 business days prior to the scheduled meeting. Section2. The published agenda, significant items of business, and related information shall be disseminated by the President at least 72 hours prior to a meeting. Article II Operating Rules of Academic Senate Meetings Section 1. The rules of order shall be determined by the Senate (see Constitution, Article VI, Sec. 1 (c) Section 2. Discussion at a meeting, for both Senators and guests, shall be limited to discussion items listed on the agenda. Section 3. The President may entertain added agenda items at the beginning of Senate meetings. Section 4. The Senate shall determine when a motion shall be submitted to a referendum of the faculty by a majority vote of a quorum. Referenda concern matters that affect college policy and require a majority vote on secured ballots, which include pro and con arguments for passage. Section 5. Voting on a significant item of business shall take place at a meeting subsequent to the one at which it was discussed. Emergency action items may be added to the agenda at the discretion of the President. Section 6. Voting on main motions, amendments, and resolutions shall be recorded by the recording secretary by a tally of yes, no, abstentions. A roll call vote may be requested by any member of the Senate at any time. Section 7. These Operating Rules may be suspended by a majority vote of the Senators present in order to move into a Closed Session with no minutes. No action may be taken during a Closed Session. Section 8. A quorum is fifty (50) percent or more of the representative Senate. Article III Academic Senate Minutes All meetings shall be recorded, except for Closed Sessions. Unapproved draft minutes shall be distributed to Senators 72 hours before the next Senate meeting. Minutes shall be approved at the next regular Senate meeting. Approved minutes shall be available to all regular and contract faculty, the administration and the Board of Trustees. A Senators name is generally included in the minutes when the Senator introduces a significant new point. Minor additions and restated points are usually summarized in the minutes without including Senators names. The representative Senate has the final responsibility to approve the minutes when the Senate is satisfied that the minutes accurately reflect the actions and discussion of the meeting. Article IV Internal and External Functions Section 1. When the Academic Senate considers its rules and procedures, a Parliamentarian may be appointed by the President with the concurrence of a majority of the Senators present at the first meeting. Section 2. Delegates to the State-wide Academic Senate shall be appointed by the President with the concurrence of a majority of the Senators present. Section 3. Appointments to specific committees of the Senate and standing college committees, district committees, and task forces shall be made by the President with the approval of a majority of the Senators present. Section 4. Standing Senate subcommittees and task forces shall operate under the rules that govern the Senate. Section 5. Senate representation shall be determined by a ratio formula as decided by the Academic Senate at the beginning of each Academic Year. Currently the ratio formula shall be 10:1 using the number of full time employed faculty (including those on leaves and sabbaticals). The number of senators will be rounded to the nearest multiple of ten. The same ratio will be across over Divisions. All Divisions are entitled to no fewer than 2 representatives. Article V Terms of Office Senators Section 1. Senators shall serve for a minimum of one year, with a maximum of three consecutive years, unless the Division votes to extend their term as outlined in Section 2 below. Section 2. A Senator may be elected to a new term where term limits are exceeded providing that the electing body, with full knowledge that term limits will be exceeded, confirms by a two-thirds vote to elect the Senator. Section 3. A Senator may be elected to a Senate office (President, Vice-President, Secretary or Treasurer) in any of their three year terms, thus extending their term to a maximum of five years. Section 4. When a faculty member has served as an officer and/or Senator for five consecutive years, they must be non-active in the Senate for one year before becoming eligible to serve again. Section 5. If a Senator resigns during a term of office, a new Senator shall be elected by the Division. Section 6. Recall from Office. A Senator may be removed from office by a two-thirds division vote of the electing body. Article VI Officers of the Senate Section 1: Eligibility for Office All Officers of the Senate shall be full-time faculty (contract or regular). No faculty member serving as President of the faculty bargaining unit shall be eligible for the office of Senate President. To be eligible for the office of Senate President or Vice President, the candidate must be tenured faculty. Section 2: Procedures for Elections of Officers and Part-Time Representatives The following procedures shall be followed for each yearly election of 91ؿ Academic Senate Officers: Election Committee Selection 1. Two or more members of the full-time faculty (contract or regular) who are not candidates for offices shall be appointed by the President to an election committee, with the approval of the Senate. The committee may include one part-time representative who is not a candidate for office. Election Committee Procedure The election committee shall canvas the eligible faculty to develop a slate of officer candidates, actively teaching in the election semester. The Election Committee shall present the slate of officer candidates at the third to last Senate meeting of the academic year, unless the Senate votes to change this date. Officer nominations may be made from the floor at this meeting, and the nominated candidates must give consent to be placed on the ballot. The election committee shall prepare a secure ballot which allows for write-in candidates for each office. Candidates may make their views known via an email to all faculty, to be distributed by the election committee one week prior to the ballot distribution. The election of officers shall take place prior to the last Senate meeting. Election tabulating procedure: One full-time faculty (contract or regular) vote shall be equivalent to five part-time faculty votes. Full-time faculty who also have part-time assignments shall have only one vote. ii. Votes must be submitted by the date and time established by the election committee. iii. At the appointed time the votes will be tabulated votes by the Election Committee in the presence of the administrative assistant to the Senate. Candidates may be present during the tabulation and have the right to review the votes. Officers shall be elected by the majority of valid votes. The election committee will report the election results to the Senate. If no candidate for a given position receives a majority of valid votes, a run-off election shall be held between the candidates who receive the first and second highest number of votes. Filling Vacated Offices Should an office be vacated, the Senate President (or the Senate Vice President if the office of President is vacated) shall appoint a new officer who must be confirmed by a majority vote of the Senate membership present at the meeting following the new officer nomination announcement. Terms of Office Senate Officers The initial term of office for the President shall be two years, with possible reelection of two one-year terms. The initial term of office for the Vice President, Secretary and Treasurer shall be one year, with the possibility of reelection for two one-year terms. If any of these offices is then uncontested, they may be reelected for one additional year. ARTICLE VII MEETINGS Section 1 : Academic Senate Meetings The Senate shall meet on the 2nd and 4th Wednesdays of each month from August through May, as the academic calendar allows. Actions of the Senate shall be approved by a majority of the Senate voting at that meeting.
